Judge Throws Out Charges Against Abortion Doctor

Editor’s Note: Throughout the scriptures, God has made it clear that shedding innocent blood is murder, and no murderer will enter heaven. In addition to the death of the unborn baby, abortion also substantially harms the women and many times, families, husbands, boyfriends and a whole sphere of relationships connected to and surrounding each abortion. Often, lifelong guilt and other social, relational, spiritual and even physical problems follow the murder of innocent babes in the womb. Pastor Jim Bakker believes that this issue, abortion, may be the single most significant issue that brings God’s judgment on this nation more than any other.

The judge in the case of Dr. Kermit Gosnell has thrown out three of the eight murder charges, granting defense motions regarding insufficient evidence.

The defense motions to acquit after the prosecution presents a case is common but rarely granted. Common Pleas Judge Jeffrey Minehart did not explain why he granted the motions. The dismissals were on three counts where the defense claimed the prosecution could not show the babies were alive when born despite testimony from multiple staffers to that effect.

Gosnell still faces first-degree murder charges related to four infants. The judge denied an acquittal on the charges related to the overdose death of a patient. If convicted on the remaining charges, Gosnell could face the rest of his life in prison.

The defense claimed that the statements of staff did not prove the babies were alive. Even when the babies pulled away from the touch of staff, it did not mean there was “objective, scientific evidence that anyone was born alive.”

The defense’s case began Tuesday with character witnesses for Gosnell’s co-defendant.
